1. Definitions
- TrueMoney Philippines – refers to True Money Philippines, Inc., a domestic stock corporation incorporated in the Philippines. It is authorized and regulated by Bangko Sentral ng Pilipinas (BSP) as an issuer of electronic money in the Philippines. Also refers to the Company.
- TrueMoney Member – an individual who uses the TrueMoney service and whose name appears on the online form or signed enrollment or application form, as may be applicable. Refers also to the Principal Account Holder.
- TrueMoney Account – an electronic wallet that stores Philippine Peso (PhP) value in the TrueMoney Philippines system which may be used by the TrueMoney Member to avail of TrueMoney services. It is linked to the Principal Account Holder’s mobile phone number.
- Short Message Service (SMS) – a communications protocol allowing the interchange of short text messages between mobile telephone devices.

2. TrueMoney Account
TrueMoney account is a reloadable electronic wallet (debit or credit wallet) with stored value that can be redeemed at indicated value. It is not a depository account, thus is not guaranteed by the Philippine Deposit Insurance Corporation (PDIC) and does not earn interest. Neither shall it earn monetary rewards and other similar incentives convertible to cash, nor special discount privileges. However, as a financial transaction, it is subject to the rules and regulations of the Bangko Sentral ng Pilipinas (BSP) and the Anti-Money Laundering Act (AMLA).
TrueMoney Philippines ensures that each TrueMoney Member would receive at face value the redeemed amount in Philippine Peso (PhP) at the main office of TrueMoney Philippines.
Furthermore, the monetary value is guaranteed regardless if the account has expired, terminated or cancelled or should the Company decide to cease operations. However, this benefit shall be forfeited in the event of any fraudulent transaction on the TrueMoney account or should it be related to any fraudulent case. The TrueMoney Member is responsible at all times for the security and integrity of the account and its access credentials. In any event of unauthorized use of the service using the TrueMoney Member’s account, TrueMoney Philippines shall not be liable for any inconvenience and damage caused to the TrueMoney Member, or any third party. Neither is the Company liable for any failure by the TrueMoney Member to avail of the service for whichever reason might be indicated.
TrueMoney Philippines may suspend or terminate use of the service for whatever legal reasons it deems proper, and the TrueMoney Member agrees to surrender the TrueMoney Accounts (where applicable)/have their wallet deactivated upon demand.
TrueMoney Philippines may suspend or terminate the use of the service for whatever reason it deems fit. The TrueMoney Member agrees to surrender the TrueMoney Account (if applicable)/have their wallet deactivated upon demand by TrueMoney Philippines. In the event of any suspension, termination or confiscation of the service, the TrueMoney Member agrees to hold TrueMoney Philippines free and harmless from any claim, damages, loss, expenses, suit or liability whatsoever, arising from such suspension, termination or confiscation.

3. Transaction and Account Limits
TrueMoney Philippines may assign or change transaction and/or account balance limits, subject to fifteen (15) days prior notice in the form of an SMS/Text message to TrueMoney Members. The limits assigned by TrueMoney Philippines shall be based on the TrueMoney account, product type, and the completeness of the information provided by the TrueMoney Member to TrueMoney Philippines.

4. SMS – Short Message Services
TrueMoney Members shall be automatically signed up for “SMS” (Short Message Service), including text alerts:
- A TrueMoney Member agrees and authorizes TrueMoney Philippines to send promotional advertisements of its products and services through mail, short messaging service, multimedia messaging services, electronic mail and other forms of telecommunication, unless it has notified TrueMoney Philippines otherwise.
- A TrueMoney Member shall abide and be bound by the instructions and/or procedures of TrueMoney Philippines during the use of SMS. The TrueMoney Member shall have no claim, recourse or remedy against TrueMoney Philippines for any loss, damage and expense incurred arising from non-compliance with such instructions and/or procedures.
- A TrueMoney Member shall not hold TrueMoney Philippines responsible or liable for any loss or damage which he/she may incur or suffer, directly or indirectly arising out of or in connection with SMS, due to any reason whatsoever including but not limited to breakdown or malfunction of the computer, its terminal connection lines, data processing system or transmission line, whether or not belonging to TrueMoney Philippines or any circumstances beyond TrueMoney Philippines’ control.
- TrueMoney Philippines is entitled to effect any changes to SMS, suspend and/or terminate SMS and to vary SMS at any time upon its sole and absolute discretion without assigning any reason and without prejudice to any of its rights of action for any antecedent breach of these terms and conditions by a TrueMoney Member.
- A TrueMoney Member hereby irrevocably agrees to hold free and harmless TrueMoney Philippines, and indemnify TrueMoney Philippines against all actions, claims, demands, liabilities, losses, damages, costs and expenses of whatever nature as a result of agreeing to this section. TrueMoney Philippines shall in no way be liable to a TrueMoney Member for any action the latter takes arising from reliance on SMS Alerts purporting to be from TrueMoney Philippines, but not originating from TrueMoney Philippines’ official SMS Alert number.

5. Activation and Deactivation of TrueMoney Service Features
TrueMoney Philippines may introduce additional service features and may also deactivate existing features at any time. TrueMoney Philippines may, on a case-to-case basis, suspend or terminate a TrueMoney Member’s privilege to use a particular feature, whenever it deems appropriate, and without prior notice. It covers, but is not limited to, occasions of fraudulent transactions or suspicious activities. However, TrueMoney Philippines may reactivate the said feature and charge a reactivation fee, upon request of the TrueMoney Member. Approval of the request shall be the sole option of TrueMoney Philippines.

6. Fees, Rates and Other Charges
The TrueMoney Member shall pay account replacement fees (if applicable) and dormancy fees in such amounts as may be imposed by TrueMoney Philippines to entitle the TrueMoney Member to the use of the TrueMoney service and the privileges that come with it. All fees are non-refundable.
The TrueMoney Member agrees to pay other fees and charges and applicable taxes related to the TrueMoney service and its use, as may be imposed by TrueMoney Philippines, Fees and other charges, as may be applicable, shall be inclusive of all applicable Philippine taxes and shall be debited from the TrueMoney account or paid or collected upfront. Should these fees and other charges result in a debit balance in the TrueMoney account, the amount shall remain outstanding and be due and demandable from the TrueMoney Member and the latter authorizes the Company to deduct the amount from the TrueMoney account upon the availability or replenishment of funds thereof without prior notice. The amount of fees and charges may be revised from time to time as TrueMoney Philippines may deem necessary.

7. Disputes of Unauthorized Transactions
Transactions are conclusively deemed authorized by the TrueMoney Member when any one of the following conditions is met: (a) the TrueMoney Member’s fingerprint has been scanned as identity validation, (b) the TrueMoney Member’s dynamic one-time and/or nominated PIN/password is successfully keyed-in, or (c) the TrueMoney Member made a request through the service hotline by dialing (02) 7718-9999 or by e-mailing [email protected]. Any one of these shall be sufficient and conclusive evidence that any and all activity has been validly initiated and authorized and cannot be disputed by the TrueMoney Member.
The details in the SMS/Text confirmation message after transactions are presumed true and correct unless the TrueMoney Member notifies TrueMoney Philippines in writing of any disputes thereon within fifteen (15) days from the date of transaction. If no dispute is reported within the said period, all transactions are deemed true and correct.
Disputed transactions shall only be credited/debited back to the TrueMoney Member’s account once the claim/dispute has been properly processed, investigated and proven have been made by TrueMoney in error. There shall be no reversals for erroneous transactions made by the TrueMoney Member.

8. Complaints
Any complaints about TrueMoney Philippines or its services should be directed to the service hotline by dialing (02) 7718-9999 or by emailing [email protected]. It must clearly state that the TrueMoney Member is filing a complaint, to distinguish the complaint from an inquiry. All complaints and feedback will be reviewed and addressed accordingly. Furthermore, this will be used to improve TrueMoney’s business and customer service.

9. TrueMoney Service Security
A TrueMoney Member shall be responsible for the security of his/her TrueMoney account, the mobile phone’s Subscriber Identity Module (SIM) and his/her one-time dynamic Personal Identification Number (PIN) and/or nominated password. All transactions made using the service are conclusively presumed made by the TrueMoney Member and the TrueMoney Member shall be responsible therefor. The TrueMoney Member has the option to change his/her PIN/password/registered mobile number from time to time or when he suspects the possibility of unauthorized present or future use of the account.

10. Loss and Theft of the TrueMoney Card/Registered Mobile Number or Device
Security and proper care of the TrueMoney account or registered device, as well as the confidentiality of his/her registered mobile number, PIN/or password, shall be the TrueMoney Member’s sole responsibility.
In case of loss or theft, TrueMoney Member shall immediately inform TrueMoney Philippines within twenty-four (24) hours through the service hotline or through a written report submitted to the company. Cancellation of the TrueMoney Account/registered mobile number or device shall be processed, only upon proper authentication of the phone call or the signature in the written report, as the case may be. All purchases and transactions made through the use of the service prior to the report of loss or theft shall continue to be the liability of the TrueMoney Member. A replacement TrueMoney Account (if applicable) may also be created at the cost of the TrueMoney Member. In addition, the lost TrueMoney Account (if applicable) will be cancelled and deactivated. The TrueMoney Member shall have no claim, recourse or remedy against TrueMoney Philippines for any loss, damage and expense incurred arising from non-compliance with these instructions and/or procedures.

11. Fraudulent Transactions
- Blocked Account – In the event that TrueMoney Philippines detects or uncovers fraudulent and/or suspicious transactions or use by an unauthorized person, the company shall have the right to automatically suspend or block the TrueMoney account. The company is not obligated to inform the TrueMoney Member regarding this action. Furthermore, the TrueMoney Member acknowledges the authority of TrueMoney Philippines to suspend or block the TrueMoney account and shall not hold the company accountable against any undue consequences due to suspension or block, nor any loss or damage thereof. Also, TrueMoney Philippines reserves the right to report any suspicious activities to the relevant law enforcement agencies.
- Discretion – Without need of giving any reason or notice, TrueMoney Philippines reserves absolute discretion (a) to refuse to approve any proposed TrueMoney transaction even if there is sufficient available balance, (b) to suspend, terminate, or cancel the TrueMoney Member’s right to use the account, (c) to increase or decrease the balance limit, (d) to refuse to reissue, renew or replace the TrueMoney account and/or (e) to introduce, amend, vary, restrict, terminate or withdraw the benefits, services, facilities and privileges with respect to or in connection with the TrueMoney account, whether specifically relating to the TrueMoney Member, or generally to all or specific TrueMoney Members.
This shall apply to events such as but not limited to:
- of any fault or failure in the data information processing system;
- that the company reasonably believes these accounts have been used, or are likely to be used or the TrueMoney Member allowed them to be used, in breach of this Agreement or to commit an offense;
- that any Remaining Balance may be at risk of fraud or misuse;
- that the company suspects a TrueMoney Member provided false or misleading information;
- that the company suspects that the account may be used to make fraudulent or suspicious transactions or be used by an unauthorized person; and
- of an order or recommendation of the Philippine National Police, other law-enforcement agencies, or any relevant governmental or regulatory authority.

12. Expiry, Renewal, Reinstatement, Dormancy, and Cancellation of Account
- Expiry, Non-Renewal or Suspension of Account – The TrueMoney Member shall not use the TrueMoney account after the expiry date indicated thereon. Renewal of the TrueMoney account shall be subject to the approval of TrueMoney Philippines. A TrueMoney account which has been suspended by TrueMoney Philippines may be reinstated by the latter at its option. The TrueMoney Member’s continued use upon suspension, termination or expiration shall be considered a fraudulent act and will be grounds for criminal action. TrueMoney Philippines reserves the right to charge a dormancy fee or not to renew, temporarily or permanently, the service upon expiration, cancellation or suspension, if the TrueMoney account remains inactive and/or not loaded over a fixed period of time as may be required by TrueMoney Philippines.
- Cancellation – The TrueMoney Member may elect to cancel his/her account even before the set expiry date. The TrueMoney Member concerned must call or provide a written notice of cancellation to TrueMoney Philippines. Customer Services shall immediately suspend all further use of his/her account, within one (1) working day upon notice. Any possible fraudulent transactions exacted due to loss, theft, or failure shall not be the accountability of TrueMoney Philippines, nor shall the company hold any legal responsibility.
- Remaining Value – Any peso value remaining in the TrueMoney account after cancellation and/or expiration shall be processed by TrueMoney Philippines according to the rules set forth by the Bangko Sentral ng Pilipinas (BSP).

13. Termination of TrueMoney Service
Should (a) the TrueMoney Member fail to comply with the Terms and Conditions provided herein or for any reason fail to renew the TrueMoney account or the TrueMoney account is not renewed by TrueMoney Philippines, (b) the account contain suspicious/fraudulent activity or (c) the TrueMoney Member dies or becomes insolvent, however evidenced, the right to use the TrueMoney account shall be terminated without prior notice and any aggregate and unpaid charges, fees and other expenses for which the TrueMoney Member is liable shall immediately become due without need of demand and may be immediately debited without prior notice from any remaining funds, money and assets of the aforementioned TrueMoney Member.

14. Change of Telephone Numbers/Address
The TrueMoney Member shall immediately notify TrueMoney Philippines via telephone or written notice of any changes in his/her residence, office or mailing address and/or telephone numbers.

15. Change of Name
The TrueMoney Member, within seven (7) days of a court decision or registered marriage, shall immediately notify TrueMoney Philippines by sending a written notice of any changes in the name of the TrueMoney Member. The TrueMoney Member shall likewise attach certified true copies of the necessary documents, such as but not limited to marriage certificate or court order, as proof or evidence of such change. TrueMoney reserves the right to refuse transactions that are not performed in the name of the TrueMoney Member that is reflected in its official records.

16. Exclusion from Liability
TrueMoney Philippines makes no warranty, express or implied, regarding the performance or functionalities of the service offered hereunder. The service is offered on an “AS IS”, “AS AVAILABLE” basis without warranties of any kind, other than warranties that are incapable of exclusion, waiver or limitation under the laws applicable to this terms. Without limiting the generality of the foregoing, TrueMoney Philippines makes no warranty (1) as to the content, quality or accuracy of data or information provided by TrueMoney Philippines hereunder or received or transmitted using the TrueMoney service functionalities, (2) as to any service or product obtained using the service functionalities, (3) that the service will be uninterrupted or error-free or (4) that any particular result or information will be obtained.
TrueMoney Philippines shall not be liable for any loss, costs, compensation, damage or liability to the TrueMoney Member or third party arising directly or indirectly as a result of any or all of the following:
- Refusal of TrueMoney Philippines, or any bank, financial institution, ATM or Merchant and the like to allow, accept or honor the TrueMoney account.
- TrueMoney Member is unable to perform or complete any transaction thru the use of any device due to service/system/line unavailability.
- Any delay, interruption or termination of the service transaction whether caused by administrative error, technical, mechanical, electrical or electronic fault or difficulty or any other reason or circumstance beyond TrueMoney Philippines’ control (including but not limited to acts of God, strike, labor disputes, fire disturbance, action of government, atmospheric conditions, lightning, interference or damage by third parties or any change in legislation).
- Theft or unauthorized use of the TrueMoney account or any loss, costs, damages or payables to any third party by the TrueMoney Member.
- Any misrepresentation or fraud by or misconduct of any third party, such as but not limited to owners or employees of TrueMoney Centers.
- Other analogous transactions that may affect, harm, and/or damage the reputation, processes, or integrity of the TrueMoney services, TrueMoney Philippines, and the TrueMoney Member, if not specified or indicated in this Terms and Conditions.

17. Limitation of Liability
In the event of any action that the TrueMoney Member may file against TrueMoney Philippines, the TrueMoney Member agrees that TrueMoney Philippines’ liability shall not exceed Five Thousand Pesos (P5,000.00) or the amount of damages actually suffered by the TrueMoney Member, whichever is lower.
Indemnity Clause – The TrueMoney Member shall reimburse TrueMoney Philippines for all actions, proceedings and claims which may be brought by or against the TrueMoney Philippines, and all losses, damages and reasonable amounts of costs and expenses which TrueMoney Philippines may incur or suffer as a result of or in connection with its providing services to TrueMoney Member under this Agreement, unless due to TrueMoney Philippines’ gross negligence or willful default and only to the extent of direct and reasonably foreseeable loss and damage (if any) arising directly and solely from it.

18. Consent to Processing of Information
The TrueMoney Member authorizes and gives consent to the TrueMoney Philippines, its associates, affiliates, subsidiaries, officers, employees, lawyers and other related persons as the company deems necessary for the following:
a. collect and verify any information about the TrueMoney Member from any third party;
b. collect, process, store, record, organize, update, modify, block, erase and destroy (collectively referred to as “process”) the TrueMoney Member’s personal and account information with the company and any information the company obtains from third parties, including account information with other financial or non-financial institutions;
c. transfer, disclose and use the TrueMoney Member’s personal and account information (including information that the company obtains from third parties, such as other financial or non-financial institutions), to, between and among its Authorized Third Parties, other financial or non-financial institutions or the outsourced service providers of such entities, wherever situated, or a Government Requirement, for any lawful purpose such as business development, data processing, analysis and management, surveys, product and service offers, marketing activities, risk management purposes, and compliance with laws
The above consent applies for the duration of and even after the closure or cancellation of the account/s. The consent will be effective despite any applicable nondisclosure agreement.
The TrueMoney Member acknowledges that information relating to him/her and his/her accounts, including Confidential Information, may be transferred to jurisdictions which may have different data protection or data privacy laws from the Philippines.
The TrueMoney Member declares that he has provided any notices, consents and waivers necessary to permit the company, its Authorized Third Parties to carry out the actions described in this provision.
The TrueMoney Member also agrees to hold TrueMoney Philippines free and harmless from any liability that may arise from the processing and use of the personal and account information, and other information pertaining to the account.

19. Venue of Litigation
Venue of all related suits shall either be at Pasig City or at any location at the exclusive option of TrueMoney Philippines.

20. Non-Waiver of Rights
Failure, omission, or delay on the part of TrueMoney Philippines to exercise its right or remedies under these Terms and Conditions shall not operate as a waiver. Any such waiver shall be valid only when reduced in writing and delivered to the TrueMoney Member.

21. Separability Clause
Should any term or condition in this Agreement be rendered void, illegal or unenforceable in any respect under any law, the validity, legality, and enforceability of the remaining terms and conditions shall not be affected or impaired thereby.

22. Amendments
TrueMoney Philippines may at any time and for whatever reason it may deem proper amend, revise or modify these Terms and Conditions without further notice. TrueMoney Philippines shall notify TrueMoney Members of pertinent changes to these Terms and Conditions via SMS or email. The TrueMoney Member’s continued use of the TrueMoney service after any such change constitutes acceptance of the new Terms and Conditions. Failure to notify TrueMoney Philippines of the TrueMoney Member’s intention to terminate his/her account shall be construed as acceptance by the TrueMoney Member of the amendment to these Terms and Conditions.

23. Agreement
The TrueMoney Member agrees to be bound by the Terms and Conditions governing the issuance and use of the TrueMoney service. A TrueMoney Member’s signature on activation or use of the TrueMoney account wallet account shall also be deemed as acceptance of and agreement to be bound by these Terms and Conditions and such amendments hereof as may be made by TrueMoney Philippines from time to time. These Terms and Conditions shall bind the members and their heirs, executors and administrators, successors and assignees, for legal accountability and documentary purposes. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
Should the TrueMoney Member disagree with the Terms and Conditions stated herein, the TrueMoney Member should provide a written notice of cancellation to TrueMoney Philippines. Within seven (7) working days, TrueMoney Philippines shall acknowledge the cancellation in either email, written notice, and/or SMS message. Otherwise, the TrueMoney Member shall continue to be liable for all charges incurred through the use of the TrueMoney service.

1. Definitions
- TrueMoney Philippines – tumutukoy sa True Money Philippines, Inc., isang domestic stock corporation, incorporated in the Philippines. Ito ay authorized at regulated ng Bangko Sentral ng Pilipinas (BSP) bilang issuer ng electronic money sa Pilipinas. Ito rin ay tumutukoy sa Company.
- TrueMoney Member – isang indibidwal na ginagamit ang serbisyo ng TrueMoney at ang pangalan ay makikita sa online form o signed enrollment o application form, kung saan ito naaangkop. Ito rin ay tumutukoy sa Principal Account Holder.
- TrueMoney Account – isang electronic wallet na naglalaman ng Philippine Peso (PhP) value sa TrueMoney Philippines system na maaaring gamitin ng TrueMoney para makapag-avail ng serbisyo. Ito ay nakakabit sa mobile number ng Principal Account Holder.
- Short Message Service (SMS) – isang protocol ng komunikasyon na nagpapahintulot sa pagpapalitan ng mga maikling mensahe ng teksto sa pagitan ng mga aparatong mobile phone.

2. TrueMoney Account
Ang TrueMoney account ay reloadable electronic wallet (debit or credit wallet) na may naka-imbak na halaga na maaaring tubusin sa isinasaad na halaga. Hindi ito depository account, kaya hindi ito ginagarantiya ng Philippine Deposit Insurance Corporation (PDIC) at hindi kumikita ng interes. Hindi rin ito maaaring kumita ng monetary rewards at iba pang insentibong convertible to cash o espesyal na pribilehiyo. Gayunpaman, bilang financial transaction, ito ay alinsunod sa rules and regulations ng Bangko Sentral ng Pilipinas (BSP) at ng Anti-Money Laundering Act (AMLA).
Sinisigurado ng TrueMoney Philippines na bawat TrueMoney Member ay makakatanggap ng katumbas na halaga ng pag-tubos in Philippine Peso (PhP) sa main office ng TrueMoney Philippines.
Karagdagan dito, ang monetary value sa debit wallets ay ginagarantiya kahit na expired na ang account, terminated, o cancelled, o kung magdesisyon ang Company na ihinto ang operasyon. Gayunpaman, ang benepisyong ito ay babawiin kapag may naganap na panloloko o pekeng transaksyon gamit ang TrueMoney account, o may relasyon sa kahit anong kaso ng panloloko. Maaaring ma-suspinde o ma-terminate ng TrueMoney Philippines ang paggamit ng service anuman ang legal na dahilan, at sumasang-ayon ang TrueMoney Member sa pag-deactivate ng kanyang wallet upon demand.
Maaaring ma-suspinde o ma-terminate ang paggamit ng service anuman ang dahilan na naaayon. Ang TrueMoney Member ay sumasang-ayon sa pag-deactivate ng kanyang wallet kung hingin ito ng TrueMoney Philippines. Sa pagkakataong ma-suspinde, ma-terminate, o ma-kumpiska ang serbisyo, ang TrueMoney Member ay sumasang-ayon na malaya ang TrueMoney sa kahit anong pag-angkin, pagkasira, gastos, suit, o anumang pananagutan, dulot ng pag-suspinde, pag-terminate, o pag-kumpiska.

3. Transaction and Account Limits
Ang TrueMoney Philippines ay maaaring magtalaga o magpalit ng transaksyon at/o ng account balance limits, sakop ng labinlimang (15) araw na abiso sa pamamagitan ng SMS/Text message sa mga TrueMoney Members. Ang limitasyon na itinalaga ng TrueMoney Philippines ay dapat naka-base sa TrueMoney account, uri ng produkto, at ng pagkakumpleto ng impormasyon na ibinigay ng TryeMoney member sa TrueMoney Philippines.

Ang TrueMoney Members ay awtomatikong naka sign-up sa “SMS” (Short Message Service), na may kasamang text alerts:
- Ang TrueMoney Member ay sumasang-ayon at pinahihintulutan ang TrueMoney Philippines na magpadala ng promotional advertisements ng mga produkto at serbisyo nito sa pamamagitan ng mail, short messaging service, multimedia messaging services, electronic mail at iba pang uri ng telecommunication, maliban na lamang kung ipinagbigay-alam sa TrueMoney Philippines na hindi man.
- Ang TrueMoney member ay nararapat na sumunod at nakatali sa mga tagubilin at/o pamamaraaan ng TrueMoney Philippines sa paggamit ng SMS. Ang TrueMoney Member ay walang pag-angkin, pag-urong, o lunas laban sa TrueMoney Philippines sa alinmang pagkawala, damage, at gastos na natamo na nagmumula sa hindi pagsunod na may ganitong tagubilin at/o pamamaraan.
- Ang TrueMoney Member ay walang karapat dapat na ipataw na responsibilidad o pananagutan sa TrueMoney Philippines sa anumang kawalan o pagkasira na maranasan nito, direkta o inderekta dulot ng o konektado man sa SMS, dulot ng alinmang kadahilanan tulad ng ngunit hindi limitado sa pagkasira o malfunction ng computer, terminal connection lines nito, data processing system o transmission line, pagmamay-ari man o hindi ng TrueMoney Philippines o ng alinmang pangyayari na hindi kontrolado ng TrueMoney Philippines.
- Ang TrueMoney Philippines ay may karapatan na palitan ang SMS, suspindihin at/o tapusin ang SMS at ibahin ang SMS kailanman sa natatangi at lubos na pagpapasya nang walang pagtatalagang rason at walang pagkiling sa alinmang karapatan nitong kumilos ukol sa alinmang pangunahing paglabag ng TrueMoney Member sa terms and conditions na ito.
- Ang TrueMoney Member ay pumapayag dito na walang panghawakan at walang panininsala ang TrueMoney Philippines, at kumpiyansa ng TrueMoney Philippines laban sa lahat ng actions, claims, demands, liabilities, losses, damages, costs, and expenses ng anumang uri bilang resulta ng pagsang-ayon sa section na ito. Ang TrueMoney Philippines ay hindi sa alinmang paraan mananagot sa TrueMoney Member sa alinmang aksyon nito ayon sa pag-asa nito sa SMS Alerts na maaaring galing sa TrueMoney Philippines ngunit hindi galing sa official SMS Alert number ng TrueMoney Philippines.

5. Activation and Deactivation of TrueMoney Service Features
Ang TrueMoney Philippines ay maaaring magpasok ng karagdagang service features, at magdeactivate ng tumatakbong features anumang oras. 6. Fees, Rates and Other Charges
Ang TrueMoney Member ay nararapat magbayad ng replacement fees (kung angkop) at dormancy fees sa halagang ipinataw ng TrueMoney Philippines para pagbigyan ang TrueMoney Member na gamitin muli ang TrueMoney service at ang mga pribilehiyong kasama nito. Lahat ng fees ay non-refundable.

7. Disputes of Unauthorized Transactions

8. Complaints

9. TrueMoney Service Security
Ang TrueMoney Member ay magiging responsable para sa seguridad ng kanyang account, ang Subscriber Identity Module (SIM) ng mobile phone at one-time dynamic Personal na Identification Number (PIN) at / o hinirang na password. 10. Loss and Theft of the TrueMoney Card/Registered Mobile Number or Device
Ang seguridad at wastong pangangalaga sa TrueMoney account o registered device, pati na rin ang pagiging kumpidensyal ng kanyang registered mobile number, PIN / o password, ay tanging responsibilidad ng TrueMoney member.

11. Fraudulent Transactions
- Blocked Account – Sakaling malaman o madiskubre ng TrueMoney ang mapanlinlang o kahina-hinalang mga transaction paggamit ng hindi awtorisadong tao, ang kumpanya ay may karapatang suspindihin agad-agad o i-block ang TrueMoney account. Ang kumpanya ay hindi obligadong pagsabihan ang TrueMoney Member ukol sa aksyon na ito. (b) na suspindihin, terminate, o i-cancel ang karapatan ng TrueMoney member na gamitin ang account, (c) na dagdagan o bawasan ang balance limit, (d) na tanggihan ang pagre-issue, pag-renew, o pag-replace ng TrueMoney account at/o (e) na magpakilala, amiyendahan, ibahin, limitahan, wakasan, o bawiin ang benefits, serbisyo, pasilidad at pribilehiyo nang may paggalang o kaugnayan sa TrueMoney account, kung partikular na may kaugnayan sa TrueMoney Member, o sa pangkalahatan o partikular na TrueMoney Members.
Ito ay nararapat sa mga sumusunod na pangyayari ngunit hindi limitado sa:
- Anumang pagkakamali o kakulangan sa data information processing system;
- Na ang kumpanya ay makatwirang naniniwalang ang mga account na ito ay nagamit, o may tsansang gamitin ng TrueMoney Member o ipinagamit ng TrueMoney Member, sa paglabag sa kasunduang ito o pagkakasala;
- Na anumang Remaining Balance ay nanganganib sa pandaraya at maling paggamit;
- Na ang kumpanya ay may paghihinala sa TrueMoney Member sa ibinigay na mali o mapanlinlang na impormasyon;
- Na ang kumpanya ay may panghihinala na ang account ay maaaring gamitin para sa mali o kahinahinalang transactions o gamitin ng hindi awtorisadong tao;
- at ng utos o rekomendasyon ng Philippine National Police, ibang kinauukulan na tagapagpatupad ng batas, o anumang gobyerno o regulatory authority.

12. Expiry, Renewal, Reinstatement, Dormancy, and Cancellation of Account
- Expiry, Non-Renewal or Suspension of Account – Ang TrueMoney Member ay ipinagbabawal na gamitin ang TrueMoney account matapos ang expiry date na nasasaad. Ang renewal ng TrueMoney account ay pagdedesisyunan ng TrueMoney Philippines. Ang TrueMoney account na na-suspinde ng TrueMoney Philippines ay maaaring maibalik ayon sa pagdedesisyon nito. Ang patuloy na paggamit ng TrueMoney Member sa pag suspinde, termination, o expiration ay ituturing na panloloko at magiging batayan ng criminal action. Ang TrueMoney Philippines ay pinanghahawakan ang kanyang karapatan na maningil ng dormancy fee o hindi pag-renew, pansamantala o permanente, sa serbisyo sa pag-expire, kasela, o suspinde, kung ang TrueMoney account ay nananatiling inactive at/o hindi napunan sa itinakdang panahon ng TrueMoney Philippines.
- Cancellation – Ang Miyembro ng TrueMoney ay maaaring pumili upang kanselahin ang kanyang account kahit bago ang itinakdang petsa ng pag-expire. Ang miyembro ng TrueMoney ay dapat tumawag o magbigay ng isang nakasulat na abiso ng pagkansela sa TrueMoney Philippines. Ang Customer services ay dapat agad na suspindihin ang account ng member sa loob ng isang (1) araw. Ang anumang posibleng mga transaksyon na kahina-hinala na natamo dahil sa pagkawala, pagnanakaw, o pagkabigo ay hindi magiging pananagutan ng TrueMoney Philippines, at hindi rin hahawak ng kumpanya ang anumang ligal na responsibilidad.
- Remaining Value – Anumang halaga ng pera na natitira sa account ng TrueMoney member pagkatapos ng pagkansela at / o pag-expire ay dapat iproseso ng TrueMoney Philippines alinsunod sa mga patakaran na itinakda ng Bangko Sentral ng Pilipinas (BSP).

13. Pagtanggal ng TrueMoney Service
Kapag (a) ang Miyembro ng TrueMoney ay nabigo na sumunod sa mga Tuntunin at Kundisyon na ibinigay para sa anumang kadahilanan na hindi ma-renew ang TrueMoney account o ang account ng ay hindi na-renew ng TrueMoney Philippines, (b) ang account ay naglalaman ng kahina-hinalang / pandaraya na aktibidado ( c) ang miyembro ng TrueMoney ay namatay o naging walang kabuluhan, subalit napatunayan, ang karapatan na gamitin ang account ay mawawalan ng bisa nang walang abiso, ang anumang hindi bayad at iba pang mga gastos ay ibabawas sa natitirang pondo, pera at mga ari-arian ng nabanggit na TrueMoney Member.

14. Pagpalit ng Telephone Numbers/Address
Ang Member ng TrueMoney ay dapat magbigay-alam agad sa TrueMoney Philippines sa pamamagitan ng pag tawag sa telepono o nakasulat na paunawa ng anumang mga pagbabago sa kanyang tirahan, opisina o mail address at / o mga numero ng telepono.

15. Pagpalit ng Pangalan
Dapat ipaalam ng miyembro TrueMoney ang anumang pagbabago sa kanyang pangalan sa loob ng pitong (7) araw mula sa desisyon ng korte o nakarehistro na kasal, sa pamamagitan ng pagpapadala ng isang sulat ukol sa pagbabago ng pangalan ng member ng TrueMoney.
Ang TrueMoney Member ay dapat maglakip ng sertipikadong totoong kopya ng mga kinakailangang dokumento, tulad ng sertipiko ng kasal o utos ng korte, bilang patunay o katibayan ng naturang pagbabago. Kung wala ang mga naturang dokumento may karapatan ang TrueMoney na tanggihan ang mga transaksyon ng miyembro.

16. Pagbubukod ng Pananagutan
Walang pinararating na garantiya ang TrueMoney Philippines tungkol sa performance o functionalities ng mga serbisyo nito. Ang serbisyo ay inaalok bilang “AS IS”, “AS AVAILABLE” basis na walang garantiya maliban na lamang sa mga garantiya na hindi maibubukod o maililimita ayon sa mga alituntuning nakasaad dito, ang TrueMoney Philippines ay walang ginagarantiyahan (1) hinggil sa nilalaman, kalidad o kawastuhan ng data o impormasyon na ibinigay ng TrueMoney Philippines, natanggap o ipinadala gamit ang mga serbisyo ng TrueMoney, (2) tungkol sa anumang serbisyo o produkto na nakuha o nagamit (3) na ang serbisyo ay hindi magagambala o mapuputol o walang error o (4) na makuha ang anumang partikular na resulta o impormasyon.
Ang TrueMoney Philippines ay hindi mananagot para sa anumang pagkawala, gastos, kabayaran, pinsala o pananagutan sa Member ng TrueMoney o ikatlong partido direkta man o hindi bunga ng mga sumusunod:
- Ang pagtanggi ng TrueMoney Philippines, o anumang bangko, institusyong pampinansyal, ATM o Merchant at iba pang katulad na pahintulutan ang TrueMoney account.
- Ang TrueMoney Member ay hindi maaaring magsagawa o kumpletuhin ang anumang transaksyon sa paggamit ng anumang aparato dahil sa hindi magagamit na serbisyo / system / linya.
- Anumang pagkaantala, pagkagambala o pagkawala ng anumang serbisyo na sanhi ng pagkakamaling administratibo, teknikal, mechanical, elektrikal o elektronikong pagkakamali o iba pang dahilan o pangyayari na lampas sa kontrol ng TrueMoney Philippines (kabilang na ang mga sumusunod: mga pangyayari na gawa ng Diyos, welga, sunog, pagkilos ng gobyerno, kidlat, panghihimasok o pinsala ng mga ralyista o anumang pagbabago sa batas).
- Pagnanakaw o hindi awtorisadong paggamit ng True Money account o anumang pagkawala, gastos, pinsala o pambayad sa awtorisadong partido TrueMoney Member.
- Anumang maling impormasyon o pandaraya sa pamamagitan ng o maling gawain ng anumang partido, ngunit hindi limitado sa mga may-ari o empleyado ng TrueMoney Centers.
- Ang iba pang mga pagkakatulad na transaksyon na maaaring makaapekto, makasasama, at / o makapinsala sa reputasyon, proseso, o integridad ng mga serbisyo ng TrueMoney, TrueMoney Philippines, at ang Member ng TrueMoney, kung hindi tinukoy o ipinahiwatig sa mga tuntunin at kondisyon na ito.

17. Limitation of Liability
Kung may anumang aksyon na maaaring isampa ng Miyembro ng TrueMoney laban sa TrueMoney Philippines, sumang-ayon ang Miyembro ng TrueMoney na ang pananagutan ng TrueMoney Philippines ay hindi lalampas sa Limang Libong Piso (P5,000.00) o ang halaga ng mga pinsala na talagang pinagdudusahan ng Member ng TrueMoney, alinman ang mas mababa.
Indemnity Clause – Ang Miyembro ng TrueMoney ay dapat bayaran ang TrueMoney Philippines para sa lahat ng mga aksyon, paglilitis at pag-aangkin na maaaring dala ng o laban sa TrueMoney Philippines, at lahat ng pagkalugi, pinsala at makatwirang halaga ng gastos at gastos na maaaring mangyari o magdusa ang TrueMoney Philippines bilang resulta ng anumang pagbibigay ng mga serbisyo sa TrueMoney Member sa ilalim ng Kasunduang ito, maliban na lamang dahil sa labis na kapabayaan at pinsala (kung mayroon man) ng TrueMoney Philippines.

18. Consent to Processing of Information
Pinapahintulutan ng TrueMoney Member ang TrueMoney Philippines na gawin ang mga sumusunod:
a. pagkolekta at pagpapatunay ng anumang impormasyon tungkol sa TrueMoney Member sa iba pang third party,
b. pagkolekta, pagproseso, pagtago, pagtala, pag-ayos, pag-update, pagbago, pagpigil, pagbura at pagsira ng anumang personal at iba pang impormasyon ukol sa account, kasama ang impormasyon nakalap ng kumpanya mula sa third party, lalo na ang account information nito sa ibang institusyon, pinansyal man o hindi, at
c. paglipat, pagbunyag, o paggamit ng personal na impormasyon hinggil sa account para sa business development, data processing, analysis, at management, survey, product and service offers, marketing activities, risk management, at pagsunod sa batas. Pumapayag din ang TrueMoney Member na ‘di pananagutin ang TrueMoney Philippines sa anumang pananagutan o kakulangan na maaaring idudulot ng pagproseso at paggamit ng impormasyong personal o hinggil sa account.
Ang pahintulot na ito ay hanggang sa durasyon o kahit na matapos ang pagsasara o pagkansela ng mga account/s. Ang pahintulot ay magiging epektibo sa kabila ng anumang naaangkop na kasunduan na hindi pagsisiwalat.
Kinilala ng Miyembro ng TrueMoney na ang impormasyon na may kaugnayan sa kanya at sa kanyang mga account, kasama ang Confidential Information, ay maaaring ilipat sa mga nasasakupan na maaaring magkaroon ng iba’t ibang proteksyon ng data o mga batas sa pagkapribado ng data mula sa Pilipinas.
Ang pagdeklara ng TrueMoney Member ay pagpapahayag na siya ay nagbigay ng anumang mga abiso, at pahintulot upang pahintulutan ang kumpanya, ang awtorisadong partido na isagawa ang mga aksyon na inilarawan sa probisyong ito.
Sumasang-ayon ang Miyembro ng TrueMoney na hayaan ang TrueMoney Philippines sa anumang pananagutan na maaaring lumabas mula sa pagproseso at paggamit ng impormasyon ng personal account, at iba pang impormasyon na nauukol dito.

19. Lugar ng Paglilitis
Isasakdal sa mga nararapat na korte lamang ng Lungsod ng Pasig ang lahat ng mga kaso o asunto.

20. Non-Waiver of Rights
Ang pagkabigo, pagtanggi, o pagkaantala sa bahagi ng TrueMoney Philippines upang magamit ang kanyang karapatan o mga remedyo sa ilalim ng Mga Tuntunin at Kundisyon na ito ay hindi dapat maging balakid. Ang anumang nasabing pagtanggi ay magiging wasto lamang kapag naisulat at maihatid sa Member ng TrueMoney.

21. Separability Clause
Kung sakaling may bahagi ng Terms and Conditions sa Kasunduan na ito na ginawang walang-bisa, ilegal o hindi maipapatupad sa batas, hindi maaapektuhan ang bisa, legalidad at pagpapatupad ng natirang mga probisyon.

22. Mga Susog:
Maaring baguhin, dagdagan at pagandahin sa ibat-ibang rason, sa kahit ano mang panahon at oras ang Terms and Condition ng walang agbiso. Magbibigay anunsyo ang TrueMoney Philippines sa lahat ng TrueMoney Members sa mga pagbabago sa Terms and Condition sa pamamaraan ng SMS or Email. Ang patuloy na pag gamit ng TrueMoney member pagkatapos ng anumang pagbabago ay ang buong pagtanggap sa bagong mga tuntunin at kundisyon. Ang hindi pagpa-paalam sa TrueMoney Philippines ng hangarin ng isang miyembro na wakasan o ikansela ang kanyang account ay dapat ipahiwatig bilang pagtanggap ng member ng TrueMoney ng susog at Tuntunin at Kundisyon.

23. Kasunduan
Sumasang-ayon ang TrueMoney Member sa Terms and Conditions (makikita ang full version sa www.truemoney.com.ph/retailer-terms-and-conditions) na namamahala ng pagbigay at paggamit ng serbisyo ng TrueMoney. Sa paglada ng TrueMoney member sa kanyang application form, pag-activate ng membership, at pag-gamit nito ay nagsisilbing pag tanggap sa mga Terms and conditions at ng mga susog nito na ginawa ng TrueMoney Philippines.
Ang mga Terms and Conditions ay nagsisilbing tali sa mga miyembro, kanilang tagapagmana, executors and administrator, successors at assignees para sa mga legal na pananagot at mga panukala at ito ay sakop at ginawa batay sa mga batas ng Republika ng Pilipinas.

Kung ang TrueMoney Member ay hindi sangayon sa mga Terms & Conditions na nakasaad, magbigay lamang ng written cancellation notice sa TrueMoney Philippines. Sa loob ng isang linggo, magbibigay ng acknowledgement of cancellation via email, written notice o SMS message. Kung hindi ito nagawa, magsisilbing valid at pananagutan pa din ito ng TrueMoney Member at magiging responsable sa mga charges na nagamit sa pag gamit ng TrueMoney Service.
